IMPORTANT UPDATE FROM TEXAS DPS: CLEARINGHOUSE DOWNGRADES.
The following information is being passed along from the Driver License Division. This could affect existing CDL holders that have a PROHIBITED status in the Drug & Alcohol Clearinghouse. It is extremely important that Districts run driving records as required by rule to ensure that drivers have not been downgraded.
Effective, Monday, July 1st , the Texas Department of Public Safety (DPS) will not issue, renew, upgrade, or transfer a CDL or CLP, for any individual prohibited under FMCSA's Drug and Alcohol Clearinghouse (DACH) regulations from performing safety-sensitive functions, including driving a CMV, due to one or more drug and alcohol program violations. Furthermore, the Department will downgrade the driver by removing the commercial driving privilege from their driver's license if they are prohibited in the DACH database.
To have the Clearinghouse status change from “prohibited” to “not prohibited,” the driver must complete the return-to-duty (RTD) process through their employer.
Timeline of DACH implementation:

Beginning July 1, 2024, DPS will confirm driver’s eligibility status in the DACH database for all CDL and CLP transactions. If not eligible, the transaction will be canceled.

During the first week of July, DPS will send a notice to all drivers that are in the prohibited list in the DACH database to comply with DACH requirements. These are drivers that have been prohibited from January 6, 2020, to July 1, 2024.

Drivers who do not comply with the DACH requirements will receive the downgrade notice of the CDL or CLP privileges until they complete the Return to Duty (RTD) process.
